FINRA reports that the United States Securities and Exchange Commission (SEC) filed a civil injunctive action charging Zachary Berkey with making unsuitable trades that were costly for customers and lucrative for the brokers. The allegations state that Zachary Berkey violated the antifraud provisions of the federal securities laws. The complaint states that since the customers incurred significant costs, a $75 “fixed transaction commission”, with every transaction and the securities were held briefly, the price of securities had to rise significantly for customers to realize even a minimal profit.

FINRA reports that two claims were filed alleging sales practice violations against Zachary Berkey. The claims alleged churning resulting in losses, unauthorized trading and misrepresentation. The claims were settled for as high as $231,000.

If you lost any money on investments with Zachary Berkey, you may be able to recover your losses from Four Points Capital Partners LLC and/or National Securities Corporation. This is because Four Points Capital Partners LLC and National Securities Corporation had a duty to supervise Zachary Berkey.
