Goodman & Nekvasil P.A., May Recover Investor Losses – Richard Lee Ewalt (Richard Ewalt) Suspended from Securities Industry and Resigned from BB&T Investment Services, Inc.

From 2011 until Richard Ewalt’s resignation in 2013, Richard Ewalt was licensed with BB&T Investment Services, Inc. According to FINRA’s records, Richard Ewalt resigned from BB&T Investment Services, Inc. on June 5, 2013. BB&T Investment Services, Inc. reported to FINRA that Richard Ewalt’s resignation related to clients alleging that signatures on various account documentation were non-genuine.

Subsequent to Richard Ewalt’s resignation from BB&T Investment Services,Inc., FINRA investigated Richard Ewalt and brought a disciplinary action against Richard Ewalt. Richard Ewalt was fined $10,000 and suspended for 1 year from the securities and investment banking industry on June 4, 2014. FINRA reports that Richard Ewalt consented to the sanctions and to the entry of findings that Richard Ewalt affixed non-genuine signatures or initials of customers on documents. The findings stated that these documents were important records of Richard Ewalt’s member firm and included, among other things: Firm variable annuity disclosure forms; State of Maryland disclosure forms; variable annuity exchange forms; firm client profile declarations and worksheets; and individual retirement account (IRA) transfer forms. According to FINRA, Richard Ewalt signed the customers’ signatures or initials to the foregoing documents without the customers’ knowledge, authorization, or consent and by falsifying the customers’ signatures or initials on firm documents, Richard Ewalt caused Richard Ewalt’s firm to prepare and maintain inaccurate books and records.

FINRA reports that Richard Ewalt was suspended from the securities and investment banking industry again on May 26, 2016. FINRA reports that Richard Ewalt failed to comply with an arbitration award or settlement agreement or to satisfactorily respond to a FINRA request to provide information concerning the status of compliance.

FINRA also reports that a complaint was filed involving Richard Ewalt’s conduct with BB&T Investment Services, Inc., with the client alleging that it is not his signature on several documents related to his annuity purchase in 2012. This complaint was settled. FINRA also reports that a second complaint involving Richard Ewalt’s conduct with a prior firm, alleging misrepresentation, was also settled.
