Anna Khai was licensed with Morgan Stanley from 2012 to 2014. Anna Khai was previously licensed with HSBC Securities (USA) Inc. Anna Khai was barred from the securities industry by the Financial Industry Regulatory Authority (FINRA) on July 28, 2014. FINRA reports that Anna Khai failed to respond to FINRA request for information.
Prior to Anna Khai’s bar from the securities industry by FINRA, an arbitration claim involving Anna Khai’s conduct with Morgan Stanley Smith Barney, LLC was filed, alleging wrongful conduct, breach of fiduciary duty, constructive fraud, fraud by misrepresentation and omission, breach of written contract, failure to supervise, and violation of state and federal securities laws, NASD Rules of Fair Practice and NYSE Rules. This case did not settle and proceeded to final hearing. The causes of action relate to Claimants’ allegations that Anna Khai ran a Ponzi scheme, took personal loans, and recommended unsuitable investments including the Jackson National Life annuity. The arbitrator found Morgan Stanley Smith Barney, LLC liable and ordered Morgan Stanley Smith Barney, LLC to pay $825,000, which included punitive damages in the amount of $165,000. The arbitration panel specifically found that Morgan Stanley’s “hiring process was not sufficient to vet” Anna Khai.
FINRA also reports that a lawsuit was filed involving Anna Khai’s conduct with Morgan Stanley Smith Barney, alleging Anna Khai misappropriated approximately $500,000 in HELOC loans to finance an outside business interest and that the client suffered substantial lost business profits as a result of the misappropriation. This lawsuit was settled for $927,500.
