James Kearney was a previously licensed financial advisor with Raymond James & Associates, Inc. According to James Kearney’s CRD, James Kearney was suspended from the securities industry for 15 days and fined $2,500 in November 2019.
According to FINRA Allegations:
From November 2017 to May 2018 (the “Relevant Period”), James Kearney exercised discretion by placing approximately 200 trades in the accounts of 20 customers without written authorization from the customers and without acceptance of the accounts as discretionary by the Firm, thereby violating NASD Rule 2510(b) and FINRA Rule 2010. Additionally, Kearney violated FINRA Rules 4511 and 2010 by mismarking 47 of the orders for the trades as “unsolicited” and by marking none of them as discretionary, thereby causing the Firm to create and maintain inaccurate books and records in violation of Section 17(a) of the Securities Exchange Act of 1934 (“Exchange Act”) and Rule 17a3 thereunder

A customer dispute was filed alleging sales practice violations against James Kearney.
Customer Dispute 11/15/18: Client alleges investments were unsuitable and trades were excessive and not authorized. This customer dispute was settled for $50,000.
