Clark Gardner was previously registered with Cetera Advisors LLC in Orem, Utah. According to Clark Gardner’s CRD, Clark Gardner was barred by SEC in June 2016.
According to the SEC, on February 12, 2016, Clark Gardner pleaded guilty to four counts of securities fraud, a second-degree felony, in violation of Utah Code Ann. § 61-1-1 before the Third District Court, Salt Lake County, State of Utah, in State of Utah v. Clark Smith Gardner, Case No. 151906284. On March 25, 2016, Respondent was sentenced to a suspended term of not less than one year or more than fifteen years in the Utah State Prison. Clark Gardner was sentenced to seven years of probation and ordered to pay restitution in an amount to be determined. The counts of the criminal information to which Clark Gardner pled guilty alleged, inter alia, that in connection with the offer, purchase or sale of securities, commencing on or about November 2011 through April 2014, Clark Gardner obtained money and property by means of materially false and misleading statements or omitted to state material facts necessary in order to make the statements made, in light of the circumstance under which they were made, not misleading or engaged in an act, practice or course of business which operated or would operate as a fraud or deceit.
According to Clark Gardner’s CRD, Clark Gardner was also barred by FINRA, whom alleged that without admitting or denying the findings, Clark Gardner consented to the sanction and to the entry of findings that he converted customer funds. FINRA alleged that a customer provided Clark Gardner with a check for $243,000 for an investment opportunity, in which Clark Gardner deposited directly into his personal bank account. According to FINRA, Clark Gardner failed to invest any of these funds on the customer’s behalf and proceeded to use the customer’s funds for personal use, including using the funds to repay funds Clark Gardner owed to other individuals.
According to Clark Gardner’s CRD, Clark Gardner was fined by the Utah Insurance Department in the amount of $2,500.00. Based on Clark Gardner’s CRD, the Utah Insurance Department alleged that Clark Gardner and another financial advisor distributed copies of a brochure promoting a specific insurance policy that communicated false or misleading information, and further alleged to have utilized an unlicensed insurance agency.
According to Clark Gardner’s CRD, a customer complaint was filed against Clark Gardner based on allegations pertaining to unsuitable investments. According to Clark Gardner’s CRD, this customer complaint was settled in the amount of $263,000.00.
