Guy Conger was formerly licensed with Money Concepts Capital Corp. in San Antonio, TX. FINRA reports that Guy Conger was suspended from the securities industry for 6 months and fined $15,000 in February, 2018.
According to FINRA: Guy Conger consented to the sanctions and to the entry of findings that Guy Conger improperly used discretion to place trades in customers’ accounts. The findings stated that although the customers had given Guy Conger verbal permission to use discretion in the accounts, Guy Conger did not receive written authorization to use discretion in the accounts and his member firm had not accepted the accounts as discretionary. The findings also stated that Guy Conger caused Guy Conger’s firm’s books and records to be inaccurate by mismarking order tickets as unsolicited when they were solicited, and mismarking order tickets as not discretionary trades when they were discretionary. The findings also included that Guy Conger falsely completed annual compliance attestations stating that he had not used discretion in customer accounts during the prior year, when, in fact, he had. FINRA found that Guy Conger made misleading and unwarranted statements in email communications with customers. Guy Conger’s statements in the emails to the customers included false, exaggerated, unwarranted, promissory or misleading statements or claims and an unwarranted prediction of performance.
